Terms and Conditions

You ("you") acknowledge and agree to these Terms & Conditions (the "Terms") by making a reservation for or using a tour, as well as any associated goods or services (a "Tour"), from Tajmahaltours.com by Culture Holidays India Pvt Ltd.

You confirm that you have read, understood, and agreed to be bound by these Terms by making a reservation for a Tour with us. You guarantee that you are authorized to accept these Terms on behalf of the other participants in your party if you make a reservation on their behalf.


Prices, Surcharges, and Taxes

We reserve the right to change the cost of unsold tours at any moment and to make corrections to the costs of tours that have been confirmed. Additionally, we reserve the right to increase the cost of confirmed tours in order to cover increases that directly result from changes in the following: The cost of passenger carrying due to fluctuations in the price of fuel or other power sources;

The amount of taxes or fees that apply to services related to the holidays that are imposed by outside parties who are not directly involved in its tours, such as tourist taxes, landing taxes, or fees associated with arriving at or departing from ports and airports, as well as the exchange rates that are relevant to the package.

The tour operator may occasionally provide discounted rates on specific products or services. Discounts are only valid for brand-new reservations. Reduced prices are not applicable to reservations for whom the tour operator has not received payment of at least a deposit.


Deposits

A non-refundable deposit (up to the amount mentioned for that specific tour) is payable to the tour operator at the time of booking for each individual on the tour. The whole amount is due at the time of booking if it is made 60 days or less before departure.

Alternative deposit conditions apply to some of the tour operator's offerings, such as tailor-made, customized, special request tours, and day tours.

You might have to pay in full at the time of booking for some of the tour operator's offerings. Any such criteria will be communicated to you by the tour operator before the related booking is confirmed.


Payment by Credit Card

As a participant or traveler, you agree to accept full responsibility for payments made using credit cards, and you will hold Culture Holidays India Pvt. Ltd. harmless for any amount that is contested or charged back. It is required that any chargebacks or disputed amounts be quickly reimbursed to Culture Holidays India Pvt. Ltd. Immediately.


Policy Regarding Cancellation/No Show/Early Departure

We need to be informed in writing if your travel plans are going to be canceled for any reason. The cancellation fees will take effect as of the day/time that we receive written notification from you. The following cancellation penalties are applicable to land packages and/or services.

25% of the Tour will be charged for the cancellation for 120–61 days before the arrival. 40 % of the tour for 60–31 days prior to arrival. 75% of the Tour for cancelling 30 to 07 days before arrival. 06 days to 72 hours before arrival, or No Show- 100% of the tour means no reimbursement. The refund will be applied in accordance with the suggested cancellation policy at the time of booking for any associated train or airline tickets. A different cancellation policy is in effect for reservations made for special train trips and high-peak periods (December 20 to January 15). This information will be provided as needed.


Refunds

In regard to the refund of unused/unutilized services (which are paid for and canceled in advance), the refund amount would be worked out on the basis of the cancellation policy as described above and the money would be accordingly refunded to the person who has made the payment to us. Please note that the refund process may take 2 - 4 weeks due to banking procedures. If the refund is made to the credit card account OR to the Bank account, the bank will be debited from the refundable amount.

If a tour participant does not use any of the included services, such as transportation, meals, accommodation, sightseeing tours, or airfare due to personal reasons, there will be no refund or reduction given to them.


Details Required for Bookingw

As a condition of booking, you must provide the information requested by the Tour Operator along with the final payment. If you fail to supply information required by the Tour Operator for air tickets, permits, or other inclusions, you will also be liable for any costs, fees, or losses including failure to obtain or provide that inclusion. In the event that you fail to supply the information required by the Tour Operator, the Tour Operator also reserves the right to treat your booking (or the relevant component of your booking) as cancelled and levy any cancellation fees deemed reasonable by the Tour Operator, in its sole discretion.


Airfare

Unless specifically mentioned in the tour descriptions, international or other airfare is not included in the tour cost. When preparing a quote, the tour operator will quote the best rate that is currently available for the requested trip dates. Quotes are merely an estimate; neither the tour operator nor the relevant air carrier(s) guarantee a certain price.

The terms and conditions of the relevant air carrier apply to the purchase and usage of the airline ticket, and the tour operator just serves as their sales agent. For detailed details, including applicable cancellation terms, please refer to the applicable terms and conditions and conditions of carriage provided by the air carrier. The tour operator does not offer guidance or notifications on airline tickets, flight status, or delays, and is not liable for modifications to flight schedules or times.


Scheduled Departures & Cancellation of A Tour by The Tour Operator

Although we try to operate all tours exactly as they are stated, as the tours are planned many months in advance, we occasionally may need to cancel or make modifications to your reservation. We reserve the right to do so at any time.

Modifications: We shall do our best efforts to notify you about any minor changes to your tour as soon as possible if there is time before your departure, but we shall have no further obligation to you. Changing your flights by less than 12 hours, the kind of aircraft, the accommodations to something better, making little adjustments to the daily schedule, and switching carriers are a few examples of insignificant changes.

We occasionally have to make significant changes to your confirmed arrangements. When made before departure, the following are examples of "significant changes":

  • A different accommodation location for all or a significant part of your trip.
  • A switch to a lower standard of accommodations for all or a significant part of your stay.
  • A modification of more than 12 hours in your scheduled departure time or total stay.
  • A major change to your tour schedule that completely omits one or more destinations.

Should the tour operator cancel a tour prior to the departure date due to circumstances other than a natural disaster and it is not your fault or carelessness, you will be given the option to accept the cancellation from the tour operator:

  • (a) An alternative tour that is more valuable or comparable; or
  • (b) A substitute tour of lesser value in the event that none of the above is reasonably available, and to recoup from the tour operator the price differential between the initially purchased tour and the substitute tour; or
  • (c) A complete reimbursement of all costs incurred for the postponed tour.

The tour operator disclaims all liability for any incidental costs or consequential losses that you suffer as a result of the cancelled reservation, including lost income or enjoyment, non-refundable car parking or other fees, non-refundable flights or rail, visas, vaccinations, and other costs. The tour operator may, at its sole discretion, choose to provide a full refund in lieu of the options listed above. If, after departure, a major component of the tour as described is no longer available, the tour operator will, whenever feasible, make appropriate substitute arrangements. In the event that the Tour Operator is unable to offer a suitable substitute or if you legitimately decline any viable substitute, the Tour Operator has the right to reimburse you for any goods or services that you did not utilize.


Passport, Visa & Immigration Requirements & Health Formalities

It is your duty to find out information and ensure that you have all the identity and paperwork needed for entry, departure, and travel to any nation or area. This includes a current passport as well as any other travel documentation mandated by the appropriate governmental bodies, such as any visas, permits, and certifications (such as medical or immunization records, among others), as well as insurance plans. As specified on your itinerary, your passport must still be valid six months after the last day of travel with the tour operator. Before the Tour begins, you undertake full responsibility for getting all necessary documentation, visas, and permissions. You will also bear full financial responsibility for any expenses incurred due to incomplete or faulty documentation. You acknowledge that failure on your part to obtain or maintain appropriate travel paperwork will result in the Tour Operator suffering a loss or expense for which you will be fully liable. You acknowledge that the Tour Operator is not liable for any errors or omissions in the information provided, including but not limited to advice on travel documents, vaccinations, clothing, baggage, or special equipment. The Tour Operator also makes no representations or warranties regarding the accuracy or completeness of any information provided on these topics.


Acceptance Of Risk

You understand that there may be a substantial risk to your health and safety associated with the goods and services provided by the tour operator. You agree that you have thought about any possible hazards to your health and safety by booking your trip with the tour operator. By accepting these risks, you absolve the tour operator of any liability for any losses, damages, injuries, or deaths brought on by the inherent risks of travel, including adventure activities and visiting foreign locations that the tour operator arranges.

You understand that there may be a significant amount of personal risk involved in participating, particularly when it comes to engaging in physical activities, traveling to remote areas, riding in a watercraft, participating in "extreme sports" or other high-risk activities, or visiting nations with underdeveloped infrastructure. The degree and type of personal risk involved depend on the products or services booked and the location(s) in which a product or service operates. In several nations where tours are conducted, the standards of accommodation, transportation, and hygiene are frequently worse than what you may reasonably expect in your home country or region. You acknowledge that the Tour Operator is not obligated to give advice or information on regional traditions, climate, particular safety issues, physical difficulties, or applicable laws in any area where a tour, good, or service is offered. You openly accept the risks involved with traveling in such circumstances and acknowledge that you have thought about the possible risks, dangers, and problems as well as your own requirements and capacities.

You are required to adhere to all applicable rules and regulations of all nations and regions at all times. The Tour Operator may immediately terminate your travel arrangements on any product or service at your expense and without liability if you fail to comply with the aforementioned, commit any illegal acts while on Tour, or if the Tour Operator reasonably believes that your behavior is causing or is likely to cause danger, distress, or material annoyance to others. In the event that your trip plans are canceled, you will not be eligible for a refund for any unused or missed services or expenses, including but not limited to incidentals, accommodations, meals, and return transportation. When it comes to property damage, destruction, or theft that you cause while on a tour, you are liable for any charges (including cleaning, replacement, and repair fees) that the tour operator or its suppliers incur. You undertake to notify any pre-existing damage as soon as it is discovered to a tour operator representative and the personnel of the accommodations, transportation service, or facility. You pledge to use due caution for your personal safety during the tour, including but not limited to using seatbelts, harnesses, flotation devices, and helmets appropriately and adhering to all written or verbal health and safety warnings. If you disregard safety instructions or warnings, neither the Tour Operator nor its Third-Party Suppliers (as defined below) will be responsible for any losses or damages.


The Tour Operator is Not Liable for Third-Party Suppliers

To provide you with some or all of the components of your booking, the tour operator arranges with accommodation providers, activity providers, airlines, cruise lines, coach companies, transfer operators, shore excursion operators, tour and local guides, and other independent parties (collectively, "Third-Party Suppliers"). Third-Party Suppliers have the option to hire local operators and subcontractors as well. Despite using all due diligence in the selection process, the tour operator cannot be held accountable for the actions or inactions of third-party suppliers because it has no control over them and does not oversee them. The terms and conditions set forth by Third-Party Suppliers apply to any services they provide, and their liability is restricted by their tariffs, carriage conditions, tickets, vouchers, and international conventions and agreements that control the provision of their services. These could restrict or eliminate the Third-Party Supplier's responsibility. You understand that Third-Party Suppliers follow the applicable laws of the nations in which they conduct business, and the Tour Operator makes no guarantees regarding any Third-Party Supplier's compliance with the laws of any other jurisdiction or your home country.

As a result of any act or omission by any party other than the Tour Operator and its employees, the Tour Operator shall not be held accountable for any claims, losses, damages, costs, or expenses resulting from inconvenience, loss of enjoyment, upset, disappointment, distress, or frustration, whether physical or mental.

The actions or inactions of independent contractors or third-party suppliers, whether due to negligence or not, are not the responsibility of the tour operator.


Optional Extras

Any activity, mode of transportation, meal, good, or service that isn't specifically listed in the tour schedule or cost and isn't a part of the tour is referred to as an "Optional Extra." You acknowledge that the Tour Operator provides no warranties and that any assistance provided by its representative(s) in planning, choosing, or reserving any Optional Extras is entirely at your request.

You understand and agree that the third party offering the optional extras is solely liable for any loss, damages, death, personal injury, illness, emotional distress, mental suffering, or psychological injury, as well as any loss or damage to property connected to those extras.


Limitation of Liability

The Tour Operator, its parents, subsidiaries, and their respective officers, directors, successors, representatives, and assigns shall not be liable for: (A) any loss or damage to property or injury to persons caused, directly or indirectly, by the act or omission of any other provider, including, but not limited to, any defect in any aircraft, watercraft, or vehicle operated or provided by such other provider; and (B) any loss or damage due to delay, cancellation, or disruption in any manner caused by laws, regulations, acts or failures to act, demands, orders, or interpositions of any government or any subdivision or agent thereof, or by acts of God, robbery, epidemics, fire, flood, war, rebellion, terrorism, insurrection, illness, quarantine, or any other uncontrollable cause. For any such loss, damage, injury, or death, you renounce any claim against the tour operator.

The tour operator limits its liability, where permitted by all applicable international conventions, in the event that any loss, death, injury, or illness is brought about by the careless acts or omissions of the tour operator or of any Third-Party Suppliers of services that are part of the booking contract.


Force Majeure

If the Tour Operator's failure to commence, perform, or complete any duty owed to you results from an Act of God, war or warlike operations, mechanical breakdowns, terrorist activities or threat thereof, civil commotions, labor difficulties, interference by authorities, political disturbance, or any other reason, the Tour Operator will not be liable in any way for death, bodily injury, illness, damage, delay, or other loss or detriment to person or property, or financial costs both direct and indirect incurred. Any of the following, whether or not they are foreseeable, would make it unsafe or impractical for a tour to begin or continue: riots, insurrections, government restrictions, fire, extreme weather, serious health risks such as the spread of a serious disease, including any mutation or variation of Covid-19 or SARS-CoV-2, and any other cause whatsoever beyond the reasonable control of the tour operator or the third-party service provider; all of which together constitute "Force Majeure."


Local Laws and Regulations

We expect all of our tour participants to abide by the laws and regulations of the countries they visit; if they don't, we may be released from any further commitments we might have to you.


Applicable Laws

You agree to submit to the exclusive jurisdiction of the courts in Delhi, India for the settlement of any dispute arising under these Terms or pertaining to any Tour, product, or service. The Contract and these Terms are governed by the laws of Delhi, India.


Group Harmony

Any person who is deemed disruptive or incompatible with the group's interests may be accepted, rejected, or expelled by Culture Holidays India Pvt. Ltd. at its sole discretion. This includes, but is not limited to, people who are intoxicated or under the influence of drugs, which could negatively impact the experience for the other members of the group. Expenses must be paid by the passenger, including cancellation fees, additional travel expenses, and/or charges for returning home. No services that are not used can be refunded.
